1. Acceptance of terms
By accessing or using FirstSpark ("the Service", "we", "us"), an independent product operated by its individual developer, you agree to these Terms of Service. If you do not agree, please do not use the Service.
2. The Service
FirstSpark is an AI-powered self-discovery platform based on BaZi (Four Pillars). It generates personality insights, life-theme readings, and interactive narrative experiences from a user-provided birth time. The Service includes free features and paid features unlocked with Credits.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases. By using the Service you represent that you meet this requirement.
4. Accounts
You are responsible for the accuracy of your account information and for safeguarding your login credentials. Authentication is provided through a third-party provider (Clerk). You are responsible for all activity under your account.
5. Credits and payment
- Credits are a prepaid balance used to unlock AI-generated readings. Credits do not expire.
- Credits have no cash value, are not transferable, and cannot be exchanged for cash except as required by law or under our Refund Policy.
- Prices are shown at checkout. Payments are processed by our Merchant of Record, Dodo Payments, who acts as the seller of record for the transaction.
- Refunds are governed by our Refund Policy.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Reverse-engineer, scrape, or attempt to extract our prompts, narrative engine, or underlying models;
- Resell, redistribute, or commercially exploit generated content without permission;
- Interfere with or disrupt the Service's infrastructure.
7. Intellectual property
The Service, including its BaZi engine, narrative system, prompt architecture, visual design, and brand, is owned by us and protected by applicable law. Readings generated for you are for your personal use. You may share individual readings (e.g. share cards) for non-commercial purposes.
8. AI-generated content
Readings are produced by large language models (including Gemini and DeepSeek) guided by our system. AI output may contain inaccuracies. Content is generated for each request and may vary.
9. Nature of content — important
FirstSpark provides self-reflection and entertainment content grounded in the BaZi tradition. It is not divination, fortune-telling, prediction of specific future events, medical, psychological, legal, or financial advice. Our framing intentionally treats BaZi as a lens for self-understanding, not deterministic fate. Decisions you make are your own responsibility. For medical, psychological, legal, or financial matters, consult a qualified professional.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the 3 months preceding the claim.
12. Changes to the Service and these terms
We may modify the Service or these Terms. Material changes will be posted with an updated date. Continued use after changes constitutes acceptance.
13. Termination
We may suspend or terminate access for breach of these Terms. You may stop using the Service at any time.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.
